1      Acceptance of terms and conditions

 

1.1        This document sets out the terms and conditions of use (Conditions) of www.ukservicehub.co.uk (Website). By accessing and using the Website you agree to be bound by these Conditions. If you do not accept these Conditions you must not use this Website.

1.2        The Conditions may change at any time without any notice. Your continued access and use of the Website shall be deemed to be your acceptance of any amendments to the Conditions.

 

2      Information about us

 

1.1        The Website is owned and operated by Alishi Limited (Company) registered in England under company number 07424764 with registered office at 253 Alcester Road South, Birmingham B14 6DT.

 

3      Website service

 

3.1        The Website is an online platform which puts its members (Members) that are service users (Users) in contact with those that are service providers (Providers). The Company’s aim is to make it easy for Users to find trusted Providers, where possible, by encouraging accredited Providers to join and by regular User feedback. However, the information compiled by the Website is supplied by Users and Providers, and the Company takes no responsibility for any omissions or inaccuracies in the information supplied to the Website.

3.2        The Company is not a party to the contractual relationship between the User and the Provider. It is up to the User to ensure suitability of the Provider with respect to the quality, integrity, or any other aspect whatsoever of the services supplied by the Provider to the User. The Company shall have no liability with respect to the aforementioned.

3.3        The Company does not make any warranties, whether express or implied, about the services which originated through the Website, including but not limited to the Provider profiles or User reviews.

3.4        With respect to paragraphs 3.2 and 3.3, you agree that the Company is not acting as an agent of any User or Provider.

3.5        The Website may contain links to the websites of other companies. You agree that the Company is not responsible for the quality, content or availability of such websites.

3.6        Access to the Website, in part or in entirety, may be withdrawn at any time and for any period. The Company shall not be liable for loss of access to the Website by Users and Providers.

3.7        You will not use the Website for any purpose that is unlawful or prohibited by these Conditions.

3.8        In the event of any breach of these Conditions, you shall indemnify the Company against all costs, losses and damages incurred by the Company.

 

4      Becoming a Member

 

4.1        Users and Providers need to register in order to become Members and make use of the Website service.

4.2        Users and Providers may apply for membership by completing and submitting an online application form. Submission of the application form constitutes an offer by a User or Provider to become a Member. However, this submission is not a confirmation of membership and the Company reserves the right to refuse membership. If the application for membership is accepted, the acceptance shall be confirmed in an email to the Member.

4.3        Whilst the Website service for Users is free, the Provider membership (after 30-day free trial) is a paid service and payment for this service can be made by major debit and credit cards.

4.4              The maximum duration of Provider membership shall be 12 months which shall commence immediately upon receipt of payment. The renewal of Provider membership shall be at the absolute discretion of the Company which may withdraw such renewal without notice at any anniversary of the commencement date.

4.5              If a Provider does not wish to continue the paid membership, it can cancel the membership by giving to the Company not less than 7 days’ notice prior to the next renewal date. The Provider shall remain liable for the membership fee up to the next renewal date.

4.6              The Company reserves the right to terminate membership at any time and without notice if there has been a breach of these Conditions by a Member. This may lead to such action by the Company as it deemed necessary including, but not limited to, withdrawal of access to the Website, issuing of a warning, legal action, and disclosure of information to law enforcement bodies.

 

5      Use of Website by Members

 

5.1              In using the Website, you agree to comply with relevant local, national, and international law.

5.2              You may not use the Website in any way that is unlawful or fraudulent.

5.3              You may not use the Website in any way that is harmful to the operation of the Website including, but not limited to, transmitting or uploading any data that may contain viruses or similar harmful programs.

5.4              You agree that any material uploaded to the Website by you is truthful and accurate, and is not offensive, derogatory, defamatory, or hateful, nor is it construed as sexually explicit, promoting violence or discrimination based on race, gender, sexual orientation, disability, age or religion.

5.5              You agree that your use of the Website, including uploading of any material, shall not breach copyright or intellectual property right or other similar rights of any other party. You agree that, in the event of a breach of this nature, you shall fully indemnify the Company against all claims, costs and liabilities arising in connection with such a breach.

5.6              If the Company considers that the material uploaded by you to the Website does no comply with these Conditions (including Clauses 5.4 and 5.5), the Company has the right to remove such material from the Website and you shall indemnify the Company for any loss or damage as a result of such non-compliance.

5.7              The information provided on the Website is solely for your personal use and you shall not exploit it for commercial purposes.

 

6      Intellectual property rights

 

6.1              Unless explicitly stated otherwise, the Company legally owns all the intellectual property rights with respect to the content of the Website including, but not limited to, design, text, graphics, software and source codes.

6.2              Except where used for personal and non-commercial purpose, none of the content and material on the Website may be reproduced, copied, downloaded, posted, stored, republished, or amended in any way without prior written permission from the Company.

6.3              In uploading material to the Website, you grant the Company unconditional right to process, use, reproduce, copy, amend, or republish the material in any way.

6.4              UK Service Hub and ukservicehub.co.uk are the trademark and domain name respectively owned by the Company.

 

7      Limitations of Company liability

 

7.1              The Company has provided the Website on an ‘as is’ and ‘as and when available’ basis, and does not make any warranties as to the accuracy, completeness or availability of the information on the Website. To the extent permitted by law, the Company shall not be liable for any direct, indirect or consequential loss or damage resulting from access to, or use of, the Website.

7.2        The Company shall not be liable for any loss or damage to your data, software or hardware arising out of harmful material on the Website.

7.3        In any event, the Company liability shall not exceed the lower of the total payment made by you in respect of the membership fee for the year in which the claim or claims incurred and £100.

7.4        These Conditions do not in any way exclude Company liability for death or personal injury arising from negligence by the Company or its employees. Nor do these Conditions exclude Company liability for fraud.

7.5        These Conditions do not affect your statutory rights as a consumer.

 

8      Severance of Conditions

 

8.1        If, for any reason, any of these Conditions are determined to be invalid, illegal or unenforceable by a competent authority, such Conditions shall be severed from the remaining Conditions which shall continue to remain in full force.

 

9      Governing law and jurisdiction

 

9.1        These Conditions shall be subject to the law in England and the jurisdiction of English courts.
